if i see one more “oh i thought tommy was nd coded” i swear to god i might actually rip my hair out
racism, misogyny, entitlement, and being an asshole are not nd traits… tommy kinard does not have nd mannerisms or speech patterns…. nothing about that man has even HINTED at being anywhere REMOTELY nd, y’all just want to come up with a way to say that hating on your favorite racist white man is bad
same with people calling him good queer rep is actually insane
not even in the context of shipping- tommy kinard is such god-awful rep
a racist misogynist asshole, who uses his queerness as a shield against valid criticism for his behavior, and acts like he has some sort of moral superiority over other queer people who are just starting to figure things out for themselves is not the paragon of queer rep you think it is, and i’m tired of seeing actual queer people pushing that narrative
especially when the straight actor leaned into physical stereotypes, put on a “gay voice,” and claimed he was doing some sort of groundbreaking work by playing a “masculine gay man” on a network tv show… the levels of audacity that his whole character post 703 has had is absolutely atrocious, and is not something i ever want to see defended again.
tommy kinard is not nd. tommy kinard is not good queer rep. you just got obsessed w a white man who kissed another white man, and paid him to lie to you on social media for a whole year, and you are scrambling to find ways to prevent yourself from looking stupid, when in reality all you’re doing is digging yourself deeper into a hole with every “headcanon” and “theory” you post about him.

Japan's third empress regnant, Empress Jitō (645-703) was a powerful and effective ruler. Shrewd, bold and clever, she walked in the footsteps of empresses Suiko and Saimei and prevailed against all odds.
A troubled youth 
Jitō was the daughter of Prince Naka no Ōe, the son of empress regnant Saimei. The year she was born, her father killed a minister in front of his mother, leading to her abdication.
Jitō’s maternal grandfather committed suicide three years later, having been wrongly accused of plotting against Prince Naka no Ōe. Jitō’s mother, Ochi, died of grief. Jitō was thus placed in her grandmother's care and raised by the former empress.
At age 12, she was married to her paternal uncle, Prince Ōama, who was 27. Jitō was a reserved person with a brilliant intelligence and much liked by the court. She was curious, open-minded and studied Chinese literature. The death of her grandmother in 661 pained her greatly. In 662, Jitō gave birth to her only child: prince Kusakabe. Her father then ascended took the throne as Emperor Tenji in 667.
Succession struggle
The question of Emperor Tenji’s succession soon arose. The sovereign favored Jitō’s half-brother, Prince Ōtomo, but Prince Ōama had his own ambitions. He and Jitō left the court, waiting for an opportunity to strike. 
Ōtomo indeed succeeded Tenji, but Ōama revolted against him soon after with Jitō's support. When they arrived at Ise province, she dressed in male clothes and personally addressed the troops. She also worked on tactical plans. As Ōama left to leave an offensive in Ōmi province, Jitō took command of the troops stationed at Ise. She had indeed volunteered to defend the shrine dedicated to the sun Goddess, Amaterasu.
Their joint efforts led to their success. Ōama ascended the throne in 673 as emperor Tenmu, with Jitō becoming his co-ruler.
The radiant empress
Jitō was very influential in court matters. This was reflected in the choice of Tenmu's heir. He could have chosen his son by another woman, Prince Ōtsu, as his heir, but chose Jitō’s son, Prince Kusakabe, instead.
As Tenmu died in 686, Jitō took the matter in hand. She declared Ōtsu guilty of treason and forced him to commit suicide. She then organized grandiose funerals for her husband and wrote poems expressing her grief. 
Oh, the autumn foliage
Of the hill of Kamioka!
My good Lord and Sovereign
Would see it in the evening
And ask of it in the morning.
On that very hill from afar
I gaze, wondering
If he sees it to-day,
Or asks of it to-morrow.
Sadness I feel at eve,
And heart-rending grief at morn—
The sleeves of my coarse-cloth robe
Are never for a moment dry. 
Her son died in 689. Since her grandson was too young to rule, Jitō became empress regnant. 
She reformed the country, establishing a strong central power and surrounded herself with capable ministers. In 689, she enacted a mandatory code for all local governors. In 690, she launched a population census.
She reformed the army, improving the recruitment conditions and the troops' training. A protector of the arts, she also actively participated in the propagation of Buddhism. Poetry became more refined during her reign. One of her poems was later included in the popular Hyakunin Isshu anthology:
The spring has passed
And the summer come again
For the silk-white robes
So they say, are spread to dry
On Mount Kaguyama 
Jitō made her predecessors' objective of replacing the tribal system with a strong central power a reality. Her rule was synonymous with a degree of stability that neither her father nor husband were able to reach. She can be regarded as one of the true founders of Japan’s imperial monarchy. The empress was also fond of travels. In 692, she undertook a trip symbolic trip to Ise province, strengthening her authority and gaining the support of the local people.
The empress indeed took advantage of the Shinto rituals and the image of the sun Goddess to reinforce her legitimacy and used the links between the deity and the imperial family. Such was her prestige that Kakinomoto no Hitomaro, one of the greatest poets of his time, compared her to a goddess.
The retired empress
Jitō’s grandson, Monmu (r. 697-707) was ready to take the throne. She stepped back as Dajō Tennō (or “retired emperor”), becoming the first sovereign in Japanese history to assume this title. The power was in reality still in her hands. The Taihō Code was promulgated in 701, reforming governmental administration as well as administrative and penal law. This was only made possible by the reforms enacted during her reign.
In 702, she went through another tour of inspection of the eastern provinces and bestowed gifts and court ranks on the local officials and leading farmers. Jitō died in the first month 703 and her ashes were interred in her husband's tomb.

The covenant, a crew of all couples. You were the only one on the crew not dating anyone. Well, you and Walter, a synthetic. He was a good conversation partner with all the chaos around. The only constant throughout the mission, guaranteed to be here after all of you died (hopefully of old age). It all started with a transmission, singing a song.
It went downhill from there, for you it became worse. You started coughing up petals. You knew there was no one else but Walter you could be having these feelings for. He would consider you as a friend, as he was incapable to think of you as anything but that. It sucked, you developing feelings for someone who can't think of you as more than a friend.
This is how you were gonna die. You've started to make peace with it. Walter just had to be Walter. He noticed something was wrong with you the minute you stepped into the meeting room. "You seem different. Did something happen?" Within a second he was right next to you. "Nothing to worry about," you answered, trying to distract yourself.
"Something did happen," he moved in your line of sight. Your eyes locking onto his. You opted to stay quiet. "You know you can tell me anything, right?" You were called by another member of the crew for help, saving you from this conversation. You'd hoped you had escaped it entirely but Walter doesn't forget easily. The next time he saw you his first question was. "Are you ready to tell me what's bothering you?"
"Couldn't you figure it out yourself?" His eyes didn't leave you, not for a second. "I could but I would feel better if you'd told me." Feel. That word enraged you, he couldn't feel and you would die because of it. You started laughing which confused Walter even more. "What's wrong?" It all just came pouring out. "You can't have feelings, that's what's wrong. I will die because I fell in love with a person who can't feel emotions."
You started coughing and petals came falling out as well as a bit of blood. Your throat scratched as if you'd just gotten the worst sore throat. Walter froze, that was the first time you'd seen him do that. He knew what was happening and what the outcome would be. He didn't know how to proceed. This was a situation his programming didn't account for. He wanted to help you. He knows he can't. "I'm sorry."
You left him. Knowing that when a person's confession is denied. They have less than 24 hours left as the flowers start spreading faster. You made sure to give Daniels all your codes and knowledge so they could at least manage without you. You had a drink with some of the crew. You wrote a letter detailing what you wished they'd do with your stuff as well as a letter to your family.
When everything was said and done, you laid in your bed waiting for the inevitable. Walter walked in. "I would like to be left alone." He didn't listen. Instead he sat down next to you. "I watched you say goodbye to everyone. Why wouldn't you tell them what's going on? They could be here with you right now."
"And their last memory of me being a tree. No thank you." His hand cupped yours as his thumb started gliding over your skin. It calmed your racing mind down. It was just him that occupied your thoughts. "Can you just hold me?" You asked as Walter obeyed without question. His arms engulfed your body as he tightly wrapped them around you. "Why can’t I say no to you?" He said before continuing.
"I realised I don't understand human emotions as much as I thought I did. You are all very complex and the world would be a worse place without you in it."
"I love you."
You thought he was just saying that in a last ditch attempt. The tightness in your chest eased. The scratching stopped and you didn't feel like a minute away from death. His words were the truth. How was that possible? He truly does love you.

hello anyone who is on neopets! okay so the faerie festival is all centered on illusen and jhudora, which i for one think is great. honestly the dynamic between those two is one of the best things neopets has going for it character-wise in my opinion. they're just so bubbline coded to me. not like illusen is that similar to princess bubblegum and jhudora is that similar to marceline, i mean not like i think they're that different either, but either way i just mean the dynamic and their interactions are so similar to me. i just want illusen and jhudora to be revealed to have dated in the past. and to date again. please tnt come on let them kiss
but anyway that's so not the point. are you a person on neopets who has never read "you had one job", a short story in issue 703 of the neopian times by user quanticdreams?? if so, please do. oh my gosh this is literally one of my favorite pieces of literature ever, anywhere. and i only ever found it because i got a short story published in that issue too ("you had one job" is the third story down on the short story tab, the picture is of jhudora, you can't miss it, and mine is the one right above it :) keep in mind though that it's personally my least favorite of everything i've had published on the neopian times though lol. literally if you read my stuff on the neopian times i will love you forever okay??????? and if anyone cares, my username is dunefurandlilypelt. um yeah that's a warrior cats thing if anyone can tell, uh i have like 18 or so journals in my room that are just filled with my completely OC warrior cats au. but nevermind all that), and gosh i'm so lucky i did because that story is part of my dna. i love it so much. i'm obsessed with it. i don't even want to spoil it because that's mean and i don't want to describe it because i wouldn't know how. read it now please

365 Writing Challenge: Day 2
Based off this post, welcome to Day Night 2! This is literally the last thing I'm doing for the day before passing out, so enjoy :D
word count: 326 (once again, this is only a small bit of what I wrote)
703 tried her hardest not to limp through the halls. She was already getting looks as it was. Limping would just make her more of a target. Besides, she needed to adjust to the pain. No doubt Master Gerd would send her out to track down general Hueland and he certainly wasn’t going to wait around for her to heal. It would only be fitting seeing as she hadn’t gotten the proper information. Though… the communications didn’t seem like her contact had ever been explicitly listed or mentioned by name. They had been surprisingly careful in keeping their communications coded and vague. Opening the door to the training rooms, the sound of clashing metal and gunfire assaulted her ears. Master Gerd slowly paced through the large room, like a leopard deciding which prey would taste best. 703 waited wordlessly as he made his way over to her. “What is it?” He asked without bothering to look at her. He continued his walk, making another lap around the room and she followed. “I wanted to discuss the info from the Oraniz facility we obtained.” “What of it?” His slight frown told her he didn’t think anything needed discussed. Perhaps he had already sent someone to deal with it.  “General Hueland—” “Yes. We’re well aware of general Hueland.” 703 gave a slight bow, keeping her eyes down. “Apologizes. I didn’t realize she had been obtained already.” Master Gerd stopped and 703 nearly ran into him. When she looked up, he was giving her a blank look. “Obtained? No. She’s gone missing. I assume she was aware we intended to interrogate her after your… display at their facility.” “Am I to retrieve her?” Master Gerd frowned. “No. She is of no importance. A military leak is nothing.” They continued walking. What was she supposed to say? It was more than just a military leak. Far more. It jeopardized the Mors and this war. She couldn’t just stay quiet, right?

"The Open Page." From the Acts of the Apostles 19: 11-14.

We traditionally think of exorcisms as a Christian practice, but at this stage of this Torah, Luke confirms He has given the Jewish people authority to peform the rite of exorcism as well.
Exorcisms which remove all ignorance about the nature and experiences of Shabbat are critical if one is to attain to full Deliverance. One cannot tune the intellect to the level of Ha Shem if one performs rote tasks. This is not possible. One simply must as the masters of Judaism have declared learn how to read the Script using Kabbalah and the Angelic Code.
To transfigure in the presence of Ha Shem is the dream vision of every Jewish person. As Luke revealed Jews in the First Century popularized this idea as the product of Passover, and it was contagious. Their Greek counterparts gave us the Gospels and the Acts, etc. and all of it was consolidated in this book, a Rosetta Stone of all the patterns of Jewish thought, much of it lost to humanity until I started this forum. The prior frame affirms this...the Jewish people are the origin of all super rational thought, but not just for their use alone. All mankind is meant to evolve per the Seven Days God laid out in the Torah.
As Luke explains next, there are also seven ways to misperform along the path. To ensure the correct interpretations of the math and also the prose in the text, he adds an Act called the Sons of Sceva, AKA "the sons of the handyman". They are, crazy as it sounds, Jews that understood how Jesus was able to read the Torah.
Recall Jesus, as a Bar Mitzvah was able to interpret the Torah better than anyone:
“After three days they found him in the temple courts, sitting among the teachers, listening to them and asking them questions. Everyone who heard him was amazed at his understanding and his answers.” — Luke 2:46–47
The prior frame confirms Three Days are the magic marker for success at reading the Torah. Our Sons of Sceva must have known this.
The Sons of Sceva
11 God was performing unusual miracles through Paul. 12 Even handkerchiefs and aprons he had used were taken to the sick, and their diseases were driven away, and the evil spirits would go out of them. 
13 Some Jews who traveled around and drove out evil spirits also tried to use the name of the Lord Jesus to do this. They said to the evil spirits, “I command you in the name of Jesus, whom Paul preaches.” 
14 Seven brothers, who were the sons of a Jewish High Priest named Sceva, were doing this.
To make this passage clearer, we need to know more about the Mishnah it contains.
Demon possession=703, ןג‎ ‎, the id, the ego.
In Hebrew, the word "id" can refer to several things depending on the context, including "identity" (זהות), "until" or "up to" (עד, \'ad), or specific personal names like Iddo. It can also be part of larger phrases like "ukabeged ehdim" which translates to "like as rags of menstruation". The Hebrew word for "id" most commonly used in the context of personal information is "זהות" (zehut), meaning "identity". 
Recall in the prior frame the Gemara says we have to change our clothes around the time of the Third Day.
Exorcism=567, ךסז‎‎, techass, "An anger cell", "to contemplate a way to get rid of the chaff."
Chaff is what covers the emotions from the direct experience of the Self. During an exorcism all suspicion of the Self is blown away.
"The Hebrew word "chass" (חש) can be interpreted as "to think up," "to contemplate," or "to devise". It is the verb חשב (hashab). Its various meanings related to mental processes and planning. The related noun hashash (חשש) means chaff. "
I have said many times, one simply must learn how to read the Torah using the correct prescribed methodsif one is expose the emotional lights within the personality called the Sefirot. I did not invent them they have existed for centuries. They are:
Peshat, the plain (simple) or literal reading; Remez, the allegorical reading through text's hint or allusion. Derash, the metaphorical reading through a (rabbinic sermon's) comparison/illustration (midrash) Sod, the hidden meaning reading through text's secret or mystery (Kabbalah).
This is the pattern I follow in the creation of the Mishnah seen on this screen. The above is missing the oral tradition called Halachah which must be used in addition if a correct and thorough anaysis of a Jewish scripture is to be performed.
The conclusions drawn from the former are called Gemara, which are supposed to change the way one thinks and lives about one's Jewishness and the nature of Ha Shem. God invited all persons to audience with Him in the prior frame, but even still Jewish scholarship cannot be dispensed with.
Unusual miracles=989, ץףט, tseft, a tashpachet, "a handkerchief."
"The verb חשש (hashash) means to hurry, or rather to be light-footed and hence quickly moved. Noun חשש (hashash) describes chaff, which proverbially is so light that a breath of wind carries it off swiftly.
Likewise, verb חוש (hush) means to hurry or hasten. Adverb חיש (hish) means quickly.
This verb חוש (hush) may also be used to mean to be agitated, worried or enjoyed. Although some dictionaries demand that this concerns a second, identical verb, it probably isn't and simply describes the situation that arises when people are "inspired" by either joy or fear, break composure and ride their emotions like chaff does wind.
The Hebrew word for "pachet" (פֶּחֶת) means "small" or "diminished", and it is not a common word. It's derived from the verb "peh" (פֶּח) which means "to be small" or "to shrink". 
Once the demon that is has trapped one its clutches is gone, blown away by the anger cell, one traps it in a handkerchief like a glob of snot phlegm. Snot is almost always associated with the transformation that concludes with Conversion AKA Deliverance.
Handkerchiefs and aprons=635, ם‎לה, "a tiresome worrisome tedious."
A Jewish High Priest Named Sceva=2868, ךח‎סח, tachachsach, "A prince who covers the Tabernacle."
"Tachas" (תח"ש) generally refers to the word translated as "badger" in the Hebrew Bible, specifically in the context of the Tabernacle's construction and the covering for sacred objects. The Jewish Encyclopedia says that "taḥash-skins were used in making the outer covering of the tent of meeting (Ex. xxvi. 14), and covers for various utensils used in the Tabernacle: for the Ark of the Covenant (Num. iv.". 
The Hebrew word Sachar (סָכָר) can mean "a prince" or "a ruler". It's also related to the Hebrew name Sachar, which is a male given name. "Sach" is also used as a transliteration of the Hebrew root סכ (sakh), which has various meanings depending on the specific word derived from it. "
This is a curious Kabbalah that states as one "covers" the Ark of the Covenant and the Tabernacle, one uncovers the Self in readiness for one's meeting with Ha Shem.
So long as one harbors demons and delusions within oneself, Ha Shem will not complete the Audience.
The Values in Gematria are:
The Sons of Sceva=1238, יב‎לח‎, yevlech, ‎"absorption of the present."
As we noted in the prior frame being present within the penultimate reality is a must if one wants to cleave to God and expect He will cleave with thee.
v. 11-12: God was performing amazing miracles. The Number is 13154, יגקד‎, yagkad.
"The verb כדד (kdd) isn't used in the Bible but in cognate languages it means to toil severely or be very tired. In the Bible this root appears to have to do with fire: glowing or baking. Noun כד (kad) means jar. Noun כידוד (kidod) means spark or red glow. Noun כדכד (kadkod) denotes a gem, possibly a ruby."
v. 13: Some Jews traveled around and drove out evil spirits. The Number is 14805, ידףה‎ ‎, yadaffah, "the closing sheet, the final letters, the closing remarks."
v. 14: Seven Sons of Sceva were doing this. The Number is 7817, עחיז‎ , ahiz, "cheerful."
All of this boils down to the need for man to observe the Shabbos, "work for the sake of happiness." Work must not incur debt, consequences, trouble, or be non-virtuous. Should one recognize this fact, one shall be free at last of one's doubt, demons, fears, and tedium, and at last feel as if true happiness is not too far away.
The final Gemara is ןג‎ךסזץףט ם‎להךח‎סחיב‎לחיגקדידףהעחיז‎‎‎, "The Page is now open."

PLAINTIFF ASHLEY SEGURA’S MOTION TO STRIKE PORTIONS OF OFFICER C. GOODMAN’S CRASH REPORT 
TO THE HONORABLE JUDGE OF SAID COURT: 
NOW COMES ASHLEY SEGURA (“Plaintiff”) who, moves the Court to strike portions ofthe Grapevine Police Department Crash Report prepared by Ofce Caleb Goodman, and as grounds thereof would respectfully show the Court as follows: 
This is a high-speed rear-end collision case in which Defendant Aron Ramsey’s Ford Mustang crushed Plaintiff’s Honda Civic, propelling it forward and to the right on State Highway 114. 
Moments after Plaintiff’s vehicle had come to rest, Defendant Hector Cruz collided with Plaintiff’s vehicle. 
Plaintiff suffered a blow to her head among other injuries. 
She brought suit to recover damages from both Defendants. 
Ofcer C. Goodman with the Grapevine Police Department prepared the crash report attached as Exhibit 1. 
Despite the fact that he was not able to ascertain whether Plaintiff was slowing down or stopped at the time of the rear-end impact, he attributed Tex. Transp. Code 545.363(a) and Under the Influence as the sole contributing factors to the collision in question. 
Further, he charged Plaintiff with intoxication assault without any evidence of Plaintiff’s mental or physical impairment due to the ingestion of alcohol or any other substance. report: 
II 
Plaintiff moves the Court to strike the following portions of Ofcer Goodman’s police Contributing factor 98 because there is no evidence that Plaintiff committed a statutory violation of Tex. Transp. Code 545.363(a), nor was Plaintiff issued a citation for such a violation. TRE 401. Contributing Factor 67 because there is no evidence that Plaintiff was under the inuence, nor that any such alleged inuence, which Plaintiff denies, was a proximate cause of the collision in question. TRE 702, 401 and 403. 
The fourth sentence of Ofce Goodman’s Narrative Opinion, stating “U-l was under inuence-alcohol” on the same grounds than those stated under II(B), above. TRE 702, 701 and 703. 
Charge of Intoxication Assault and reference to Tex. Penal Code 49.07 in the Charges section of Ofcer Goodman’s crash report because Plaintiff was not prosecuted for any such charge, much less convicted. TRE 401 and 403. 
WHEREFORE, PREMISES CONSIDERED, Plaintiff respectfully request the Court to Order that any party who may offer Ofcer Goodman’s policy report at trial shall redact out from said report contributing factors 98 and 67 assigned to Unit 1, the statement in the narrative opinion that reads “U-l was under inuence-alcohol”, and the notations in the Charge section of the report that read “Intoxication Assault” and “PC 49.07.” 
Plaintiff also requests any other further relief, general or specic, at law or in equity, to which she may show herself justly entitled to.

DEFENDANT HECTOR CRUZ’S RESPONSE AND OPPOSITION TO PLAINTIFF’S MOTION TO STRIKE PORTIONS OF POLICE REPORT 
TO THE HONORABLE JUDGE OF THIS COURT: 
Defendant Hector Cruz files does his response and opposition to Plaintiff Motion to Strike portions of the police report and in support thereof would show the following: 
I. 
Plaintiff has not submitted any legal authority to support the Motion to Strike. 
Rather, Plaintiff’ s argument is based upon speculation about what the observations of investigating officer were. 
Plaintiff has not yet taken the deposition of the investigating officer to determine whether the officer is qualified to provide opinions or to determine the basis of any factual observations. 
As such, the Motion to Strike is not ripe for consideration. 
Additionally, Plaintiff seeks to strike portions of the police report and leave in other portions of the police report that may be equally suspect or improper. 
The entire police report needs to be struck, or none of it should be struck. 
For example, Defendant Cruz disagrees with portions of the police report regarding actions of Defendant Cruz because he will testify that he never made contact with Plaintiffs vehicle. 
He only stopped after the initial collision occurred to render aid to Plaintiff. 
If the court is inclined to strike portions of the police report, Defendant requests this Court to strike the entire police report. 
“Accident reports are admissible under Rule 803(8) as exceptions to the hearsay rule. Tex.R. EVid. 803(8). 
Rule 803(8) provides for the admissibility of records, reports, statements, or data compilations, in any form, of public officers or agencies setting forth: 
(A) the activities of the officer or agency; 
(B) matters observed pursuant to duty imposed by law as to which matters there was a duty to report, excluding in criminal cases matters observed by police officers and other law enforcement personnel; or 
(C) in civil cases as to any party and in criminal cases as against the state, factual findings resulting from an investigation made pursuant to authority granted by law; unless the sources of information or other circumstances indicate lack of trustworthiness. Tex.R. Evid. 803(8).” McRae v. Echols, 8 S.W.3d 797, 799—800 (Tex. App-Waco 2000, pet. denied) 
Absent circumstances indicating a lack of trustworthiness, accident reports setting forth the factual findings from an investigation in a civil case are admissible under Rule 803 (8). See Tex. R. Evid. 803(8) (creating a presumption of admissibility); see also I001 McKinney Ltd. v. Credit Suisse First Bos. Mortg. Capital, 192 S.W.3d 20, 28 (Tex. App—Houston [14th Dist.] 2005, pet. denied.) See also, Pilgrim’s Pride Corp. v. Smoak, 134 S.W.3d 880, 892 (Tex.App.- Texarkana 2004, pet. denied) (finding evidence inadmissible hearsay because officer was not expert in accident reconstruction); Ter—Vartanyan v. RR. Freight, Ina, 111 S.W.3d 779, 781—82 (Tex.App.-Dallas 2003, pet. denied) (discussing police ofcer‘s qualications to give opinion about cause of accident). 
An investigator's opinion based on a factual observation may be deemed admissible. Pilgrim ’s Pride, supra. 
The party opposing the admission of a report under Rule 803 (8) bears the burden to show the report's untrustworthiness. I001 McKinney Ltd, 192 S.W.3d at 28. III. 
In this case, currently, there is no evidence to show a lack of trustworthiness on behalf of the investigating officer. 
Plaintiff has provided no evidence that the officer or his report is not trustworthy. 
Plaintiff, as movant, has the burden of proof. 
Therefore, the report should not be redacted. 
However, if the portions to be redacted are found to be untrustworthy, this Defendant would ask the court to then strike the entire report as being untrustworthy- not just portions that Plaintiff does not like. 
As noted earlier, Defendant Cruz disputes that he ever made contact with Plaintiff s vehicle. 
If the entire report is not struck, Defendant would seek to admit into evidence the portions Plaintiff wants struck under the Rule 107 of Texas Rules of Evidence-Optional Completeness.

Because if the investigating officer is untrustworthy as to some of the report, other parts of the report are also untrustworthy. 
Rule 107 permits the introduction of previously inadmissible evidence when that evidence is necessary to fully explain a matter that has been raised by the adverse party. Tex.R. Evid. 107.). 
“It is designed to reduce the possibility of the jury receiving a false impression from hearing only a part of some act, conversation, or writing. 
Rule 107 does not permit the introduction of other similar, but inadmissible, evidence unless necessary to explain properly admitted evidence. 
Further, the rule is not invoked by the mere reference to a document, statement, or act.’ Ibenyenwa v. State, 367 S.W.3d 420, 423 (Tex. App-Fort Worth 2012, pet. refd.) 
Wherefore, premises considered, Defendant Hector Cruz request this court to deny Plaintiffs Motion to Strike portions of the police report, 
Alternatively Defendant Cruz requests this Court to strike the entire police report — if any portions of the report are deemed untrustworthy. 
Defendant requests such further relief to which he may show himself justly entitled.

Defendant argues in her response that Plaintiff did not submit any legal authority to support her Motion to Strike portions of the Grapevine Crash Report and that Plaintiff’ s argument is based upon speculation about what the author of the police report observed. 
He suggests Plaintiff should have taken that police officer's deposition to have evidence in support of Plaintiff’s motion to strike. 
Lastly, he states that the Court should strike the entirety of the crash report or none of it. 
Plaintiff responds as follows: 
II 
A. 
Legal Authority in Support of Plaintiff’s Motion Sections II(A)—(E) of Plaintiff’s Motion to Strike, cite the applicable Texas Rules of Evidence that support excluding the portions of the crash report that Plaintiff has moved to strike. 
Therefore, Plaintiff‘s arguments are based on applicable law and not mere speculation as suggested by Defendant CRUZ. . 
Portions related to Alcohol Must be Stricken Officer Goodman will not be able to offer any competent evidence relevant to the questions of Whether Plaintiff’s physical and mental faculties were impaired due to alcohol, or any other substance, and Whether any such impairment, which Plaintiff denies, was a proximate cause to the incident in question. TRE 702. 
This is so because Officer Goodman lacks the pre-requisite expert qualications to render opinions on these questions. Mack Trucks, Inc. v. Tamez, 206 S.W.3d 572, 583 (Tex. 2006) (“Expert testimony is required when an issue involves matters beyond jurors’ common understanding”) 
Further, even if officer Goodman was qualified in the field of toxicology, the lack of any evidence of blood alcohol concentration in Plaintiff’s body would render any opinion that she was physically and mentally impaired fatally flawed. Volkswagen 0fAm., Inc. v. Ramirez, 159 S.W.3d 897, 904-05 (Tex. 2004) (“Expert testimony is unreliable “if there is too great an analytical gap between the data on which the expert relies and the opinion offered”) 
Therefore, lack of qualifications and scientific reliability, not lack of trustworthiness, are the grounds of Plaintiffs motion to strike the following portions of Officer Goodman’s Crash Report: 
(i) Contributing Factor 67 because there is no evidence that Plaintiff was under the inuence, nor that any such alleged inuence, TRE 702, 401 and 403; 
(ii) The fourth sentence of Ofcer Goodman’s Narrative Opinion, stating “U-l was under influence-alcohol”, Id. 
(iii) Charge of Intoxication Assault and reference to Tex. Penal Code 49.07 in the Charges section of Officer Goodman’s crash report because Plaintiff was not prosecuted for any such charge, much less convicted. Id. 
C. References to t_he Texas Transportation Coge M1_lst be Stricl It is well settled under Texas law that “traffic tickets are only given for violations of penal ordinances or statues and not for the purpose of establishing fault in civil litigation. Condra Funeral Home v. Rollin, 314 S.W. 2d 278 282 S.W.2d (Tex. 1958); Cody V. Mustang Oil Tool Co., Inc. 595 S.W. 214, 215 (Tex. Civ. App. -Eastland 1980, writ. Ref’d n.r.e.). 
In this case, Plaintiff was not even issued a taffic ticket related to the Texas Transportation Code. 
However, Officer Goodman references in his Narrative Opinion [Texas Transportation Code 545.363 (a)] immediately after stating that Unit l (Plaintiff). .. “slowed or stopped.” 
This reference to section 545 .363(a) of the Tex. Transportation Code is duplicative or cumulative of the statement that Unit 1 slowed or stop, confusing of the factual issues presented to the Jury, and not relevant, TRE 401, or highly prejudicial and confusing versus its probative value, if any, under TRE 403. 
In addition, Plaintiff was not cited for this violation. 
Consequently, Factor “98” and the reference to [Texas Transportation Code 545.363 (a)] in the third sentence of Officer Goodman’s Narrative Opinion should be stricken. 
Plaintiff respectfully so requests. 
D. 
The Court Should only Strike the Portions of Officer Goodman’s Report that are inadmissible under the TRE -It Show not Stril_(e the Entire Report on an All or Nothing Approach Defendant CRUZ recognizes in section II of his response that absent circumstances indicating lack oftrustworthiness, accident reports setting forth the “dew ’ findings from and investigation in a civil case are admissible. TRE 803(8). 
He also cites 1001 McKinney Ltd. v. Credit Suisse First Bos. Mortg. Capital, 192 S.W.3d 20, 28 (Tex. App. -Houston [14th Dist.] 2005, pet. Denied) for the proposition that “The party opposing the admission of a report under Rule 803(8) bears the burden to show the report’s untrustworthiness.” 
To be clear, Plaintiff Motion to Strike the portions of Officer Goodman’s Crash Report referenced above is based on lack of qualifications and reliability regarding Officer Goodman’s Opinions and findings regarding Plaintiff s physical and mental impairment and proximate causation for the incident in connection to her physical and mental faculties; and on well settled Texas law regarding the admissibility of traffic tickets in civil litigation. 
Plaintiff Motion to Strike Portions of Officer Goodman Report are not based on a Trustworthiness Analysis -emphasis added. 
On the other hand, Defendant CRUZ does not even attempt to challenge the trustworthiness of Officer Goodman’s Crash Report. 
To the contrary, he appears to want this Court to admit it in its entirety, to his advantage, or to exclude it in its entirety, also to his advantage, since CRUZ has led a No Evidence Motion for Summary Judgment asking this Court to find that there is no Evidence that he was negligent on the occasion in question. 
Since CRUZ makes no showing of why Ofcer Goodman’s Crash Report is untrustworthy, the Court should only strike the portions that Plaintiff has shown are unreliable and inadmissible under TRE. E. CRUZ’s Real Motive to Ask this Court to Exclude Ofcer Goodman’s Crash Report in its Entire 
The real motive why Defendant CRUZ wants this Court to Strike Ofcer Goodman’s Crash Report in its entirety is because the “admissible” portions of Ofcer Goodman’s Crash Report present more than a mere scintilla of evidence that raise genuine issues of material fact on the question of whether Defendant Cruz was negligent on the occasion in question. 
Defendant CRUZ led a No Evidence Motion for Summary Judgment that is set for hearing by submission on January 29, 2021. 
Plaintiff will timely file a response to CRUZ’s No Evidence Summary Judgment using relevant and “admissible” portions of Officer Goodman’s report in support of her response. 
It appears as if Defendant’s strategic move in asking this Court to deny Plaintiff’ s Motion to Strike the inadmissible portions of Ofcer Goodman’s Report or to exclude it in its entirety is to either get highly prejudicial and inadmissible evidence admitted at trial or to take away from the Jury the genuine question of fact of whether CRUZ was negligent on the occasion in question. 
F. 
The Rule of Optional Completeness is Misplaced in the Context of Plaintiff’s Motion to Strike Portions of the Crash Report 
Plaintiff has not moved to strike any of the factual observations contained in Officer Goodman’s Crash Report. 
The statements that Plaintiff asks the Court to Strike are conclusory statements lacking evidence in support thereof. 
None of the portions of the Crash Report that Plaintiff asks this Court to strike are necessary to explain or allow the trier of fact to fully understand the part of the report offered by the Plaintiff. TRE 107. 
Therefore, Defendant Cruz Optional Completeness argument is misplaced in the context of this proceedings. 
CONCLUSION 
Plaintiffs Motion to Strike Portions of Officer Goodman’s Crash report is grounded on inadmissibility of evidence at trial prescribed under the Texas Rules of Evidence and well settled Texas law. 
Plaintiff has shown that Officer Goodman is not qualified to render opinions regarding Plaintiff s physical and metal impairment due to intoxication or proximate causation related to any such impairment. 
In addition, the record is devoid of any evidence of intoxication of Plaintiff. 
Plaintiff also cites Texas Supreme Court case law that precludes the admissibility of traffic tickets in civil litigation. 
Further, there is no evidence that Plaintiff was issued or prosecuted for any violation of the Texas Transportation Code. 
Therefore, based on guiding rules and principles of law, this Court should grant the relief requested by Plaintiff in her Motion to Strike Portions of Ofcer Goodman’s Crash Report. 
On the other hand, Defendant CRUZ wholly failed to meet his burden to show lack of trustworthiness of the admissible portions of Officer Goodman’s Crash Report or any other bases to exclude his report. 
Furthermore, CRUZ’s suggestion that this Court admit all or nothing of the Crash Report does not conform with guiding rules and principles of law in this case. 
In fact, such a suggestion is designed to impair Plaintiff s ability to respond to CRUZ’s No Evidence Motion for Summary Judgment se for a submission hearing on January 29, 2021. 
In conclusion, the Court should strike the portions of Officer Goodman’s Crash Report referenced in Plaintiff s Motion to Strike Portions of Ofcer Goodman’s Crash Report and admit the remainder of Ofcer Goodman’s report at trial. 
WHEREFORE, PREMISES CONSIDERED, Plaintiff respectfully request the Court to Order that any party who may offer Ofcer Goodman’s policy report at trial shall redact out from said report contributing factors 98 and 67 assigned to Unit 1; 
the portion of third sentence of the narrative opinion that reads “[TEXAS TRANSPORTATION CODE 545.363 
(a)]”; the fourth sentence of the narrative opinion that reads “U-l was under inuence-alcohol”; and the notations in the Charge section of the report that read “Intoxication Assault” and “PC 49.07.”

The Court has previously rule that the Court will defer any ruling on evidentiary issues until time of trial. 
Plaintiff has not yet taken the deposition of the investigating ofcer to determine whether the ofcer is qualied to provide opinions or to determine the basis of any factual observations. 
As such, the Motion to Strike is not ripe for consideration. 
Additionally, Plaintiff seeks to strike portions of the police report and leave in other portions of the police report that may be equally suspect or improper. 
The entire police report needs to be struck, or none of it should be struck. 
For example, Defendant Cruz disagrees with portions of the police report regarding actions of Defendant Cruz because he will testify that he never made contact with Plaintiffs vehicle. 
He only stopped after the initial collision occurred to render aid to Plaintiff. 
If the court is inclined to strike portions of the police report, Defendant requests this Court to strike the entire police report. 
“Accident reports are admissible under Rule 803(8) as exceptions to the hearsay rule. Tex.R. Evid. 803(8). 
Rule 803(8) provides for the admissibility of records, reports, statements, or data compilations, in any form, of public ofces or agencies setting forth: 
(A) the activities of the ofce or agency; 
(B) matters observed pursuant to duty imposed by law as to which matters there was a duty to report, excluding in criminal cases matters observed by police ofcers and other law enforcement personnel; or 
(C) in civil cases as to any party and in criminal cases as against the state, factual findings resulting from an investigation made pursuant to authority granted by law; unless the sources of information or other circumstances indicate lack of trustworthiness. Tex.R. Evid. 803(8).” McRae v. Echols, 8 S.W.3d 797, 799—800 (Tex. App-Waco 2000, pet. denied) 
Absent circumstances indicating a lack of trustworthiness, accident reports setting forth the factual findings from an investigation in a civil case are admissible under Rule 803 (8). See Tex. R. Evid. 803(8) (creating a presumption of admissibility); see also I001 McKinney Ltd. v. Credit Suisse First Bos. Mortg. Capital, 192 S.W.3d 20, 28 (Tex. App—Houston [14th Dist.] 2005, pet. denied.) See also, Pilgrim’s Pride Corp. v. Smoak, 134 S.W.3d 880, 892 (Tex.App.- Texarkana 2004, pet. denied) (finding evidence inadmissible hearsay because officer was not expert in accident reconstruction); Ter—Vartanyan v. R.R. Freight, Ina, 111 S.W.3d 779, 781—82 (Tex.App.-Dallas 2003, pet. denied) (discussing police officer’s qualifications to give opinion about cause of accident). 
An investigator's opinion based on a factual observation may be deemed admissible. Pilgrim ’s Pride, supra. 
The party opposing the admission of a report under Rule 803 (8) bears the burden to show the report's untrustworthiness. I001 McKinney Ltd, 192 S.W.3d at 28. 
III. 
In this case, currently, there is no evidence to show a lack of trustworthiness on behalf of the investigating officer. 
Plaintiff has provided no evidence that the officer or his report is not trustworthy. 
Plaintiff, as movant, has the burden of proof. 
Therefore, the report should not be redacted. 
However, if the portions to be redacted are found to be untrustworthy, this Defendant would ask the court to then strike the entire report as being untrustworthy- not just portions that Plaintiff does not like. 
As noted earlier, Defendant Cruz disputes that he ever made contact with Plaintiff’ s vehicle. 
If the entire report is not struck, Defendant would seek to admit into evidence the portions Plaintiff wants struck under the Rule 107 of Texas Rules of Evidence-Optional Completeness. 
Because if the investigating officer is untrustworthy as to some of the report, other parts of the report are also untrustworthy. Rule 107 permits the introduction of previously inadmissible evidence when that evidence is necessary to fully explain a matter that has been raised by the adverse party. Tex.R. Evid. 107.). 
“It is designed to reduce the possibility of the jury receiving a false impression from hearing only a part of some act, conversation, or writing. 
Rule 107 does not permit the introduction of other similar, but inadmissible, evidence unless necessary to explain properly admitted evidence. 
Further, the rule is not invoked by the mere reference to a document, statement, or act.’ Ibenyenwa v. State, 367 S.W.3d 420, 423 (Tex. App-Fort Worth 2012, pet. ref’d.) 
Wherefore, premises considered, Defendant Hector Cruz request this court to deny Plaintiff‘s Motion to Strike portions of the police report, Alternatively Defendant Cruz requests this Court to strike the entire police report- if any portions of the report are deemed untrustworthy. 
Defendant requests such further relief to which he may show himselfjustly entitled.

NOW COMES ASHLEY SEGURA (“Plaintiff”) Who, files this her Reply to Defendant Hector Cruz’s Response and Opposition to Plaintiff’s Supplement in support of her Motion to Strike portions of the Grapevine Police Department Crash Report prepared by Ofce C. Goodman, and as grounds thereof would respectfully show the Court as follows: 
In light of the conclusive evidence of none blood alcohol concentration on Plaintiff, a ruling on Plaintiff’ s Motion to Strike portions of Goodman’s report is ripe because Plaintiff deserves to be relieved from the unfair stigma that she has been the subject of in this case, and from the apprehension she has experienced by virtue of the unwarranted references to alcohol in Goodman’s police report. 
Plaintiff urges the Court to rule on her Motion in the context of the recent procedural history of this case and, more specifically, in light of the Court’s denial of Defendant Cruz’s No Evidence Motions for Summary Judgment. 
Cruz wants this Court to strike the entire police report or to keep it in its entirety so that he may unfairly accuse Plaintiff of driving while intoxicated or be dismissed in summary judgment, as he has already attempted. 
Plaintiff does not challenge Ofcer Goodman’s report on grounds of lack of trustworthiness as Cruz suggests. 
Instead, she challenges specific portions of his report based on Ofcer Goodman’s lack of qualifications and lack of foundation data. 
On the other hand, the rest of Goodman’s report is based on factual observations that neither Plaintiff, not Cruz have challenged. 
See section III of Cruz’s Response and Opposition to Plaintiff’s Supplement, stating “. . .there is not evidence to show a lack of trustworthiness on behalf of the investigation offer. . .” 
Based on this, Plaintiff urges the Court to not rule using an “all or nothing comes in” approach because doing so would work against the TRE, would disregard the totality of the circumstance of this case, and would be inequitable and unjust to Plaintiff. 
Neither Officer Goodman’s deposition can change the fact that Plaintiff blood alcohol concentration was none, nor can Cruz’s anticipated testimony alone (disagreeing with Officer Goodman’s observation that Cruz’s vehicle made contact with Plaintiff’ s), can erase such factual observation from Officer Goodman’s police report. 
Lastly, using the rule of optional completeness as a back door to admit evidence of alcohol is misplaced and improper because it would offend the rules of evidence that require excluding the specific portions of Officer Goodman’s report that Plaintiff has requested this Court to strike. 
Plaintiff realleges and fully incorporates by reference her Amended Motion to Strike Portions of Ofcer C. Goodman’s Crash Report, led on January 8, 202 1; her Reply to Defendant Hector Cruz’s Response to Plaintiff’s Amended Motion to Strike Portions of Ofcer C. Goodman’s Crash Report, led on January l4, 2021; and he response Objection and Response to Defendant Hector Cruz’s No Evidence Motion for Summary Judgment, led on January 22, 2021.
